Anti-Transgender Athlete Legislation
There are over two dozen states banning transgender female athletes from playing the sport they love on the team they choose, many of the bills target high school and younger athletes.
The House of Representatives passed HR28 in January 2025, which “prohibits school athletic programs from allowing individuals whose biological sex at birth was male to participate in programs that are for women or girls.”
The bill failed to pass in the Senate and blocked the attempt to have a federal law banning trans women and girls from competing on a team that corresponds with their gender identity. However, this has not stopped dozens of states enacting their own bans.
The Supreme Court of the United States (SCOTUS) will hear two cases brought by the state of Idaho and West Virginia in the fall of 2025. The outcome of these cases will set a precedent for other states to ban female transathletes.
As of November 2025 Twenty nine states have signed anti-trans athlete bills into law.
